The MoD argued that the claims were too late, but there was nothing stopping the MoD being proactive with compensation.

Mr Justice Foskett said, "All things being equal, a veteran who believes that he has an illness, injury or disability attributable to his presence at the tests whose case is supported by apparently reputable scientific and medical evidence, should be entitled to his 'day in court"'.

I would like to draw a comparison between men employed by the old National Coal, who the Government did and is still compensating.
So why do us veterans not get the same sympathetic treatment.
As servicemen, we did what was asked of us, and could not refuse to carry out our duties, unlike civilian workers, and quite a percentage was National Service personnel.

A MoD TOP LEVEL MESSAGE says:

"Unlike civil damage cases, it is not necessary to go to court or prove negligence in order to receive an award.

Key Facts:

• The standard of proof used is based on the balance of probabilities, which is the accepted approach in other schemes and in the courts. No case should fail where there is reasonable, reliable evidence that injury is due to Service."

Granted, it's in reference to the AFCS, and was probably updated by a fast stream student on summer placement, but this should apply to all claims.

Wanted, recommended Lawyer to consider representation for a veteran with the intention of making an appeal case to the Veterans Agency, with a view to possibly commencing legal proceedings, on a no win no fee bases.
